7/1/2010: Seeking Comments for the FTCA Policy Manual |

HRSA has put out a policy information notice (PIN), seeking comment on the new FTCA Policy Manual.
This notice is addressed to healthcare program grantees, primary care associations, primary care offices, national cooperative agreements, and GQHC look-alikes.
The PIN reads as follows:
"Once finalized, the FTCA Policy Manual will be the primary policy source for information on FTCA for Health Center Program grantees and related stakeholders. It will be updated as new policy and program guidance are issued. Please note, however, that when FTCA matters become the subject of litigation, the Department of Justice and the Federal courts may assume significant roles in certifying or determining whether or not a given activity falls within the scope of employment for purposes of FTCA coverage."

Yesterday (June 21) the Centers for Disease Control released new prevention strategies for combatting seasonal influenza in healthcare settings.
The strategies include vaccination programs, dealing with symptomatic patients, development of sick-leave programs and infection control techniques. This updated paper is open for comments, and replaces the 2009 H1N1 interim guidance.

Today (June 18) the Office of the National Coordinator (ONC) for Health Information Technology (HIT) released a final rule on the temporary certification program for Electronic Health Records (EHR).
The press release is available here.
Joshua Rozovsky: This a very significant step towards the adoption of electronic health records across the country. One of the challenges in the EHR debate has been the development of unified payment, technical, and certification standards. While some have expressed concern that too prescriptive an approach to standardization may inhibit innovation, certifying systems to a standard both in technical terms (data communications and security protocols) and usability (ergonomics, user-interfaces) is needed to allow widespread use of EHR systems and ensure that such systems do not inhibit, rather than aid the flow of patient information. |

From CMS: "As part of the new 2010 Affordable Care Act, the Centers for Medicare & Medicaid Services (CMS) will soon release to all States and U.S. Territories a solicitation to apply for Federal funds for a multi-year national background check program for several long term care facilities and providers." CMS is providing directions on how to handle risk management write-offs under the MMSEA 111 requirements. As described in the alert, "Risk management write-offs (including a reduction in the amount due as a risk management tool) constitute liability self-insurance for the purposes of the Medicare Secondary Payer provisions" because they reduce the likelihood of a claim.
Write-offs include items of value, such as gift cards, cash, etc.
