Final rule. SUMMARY: This final rule implements the provisions of the American Recovery and Reinvestment Act of 2009 (ARRA) (Pub. L. 111-5) that provide incentive payments to eligible professionals (EPs), eligible hospitals and critical access hospitals (CAHs) participating in Medicare and Medicaid programs that adopt and successfully demonstrate meaningful use of certified electronic health record (EHR) technology. This final rule specifies—the initial criteria EPs, eligible hospitals, and CAHs must meet in order to qualify for an incentive payment; calculation of the incentive payment amounts; payment adjustments under Medicare for covered professional services and inpatient hospital services provided by EPs, eligible hospitals and CAHs failing to demonstrate meaningful use of certified EHR technology; and other program participation requirements.

Look for a proposed rule from CMS that would revise existing regulations on the imposition and collection of civil monetary penalties for non-compliance with federal regulations governing long term care facilities. The proposed rule change also reflects requirements enacted in the Patient Protection and Affordable Care Act of 2010. The proposed rule will be published in the Federal Register on July 12, 2010.

BREAKING NEWS

Secretary Sebelius today released a Notice of Proposed Rule Making involving a number of major changes involving the HIPAA Standards for Privacy, Security as well as Enforcement.

Revised websites were announced as well by the Secretary and other members of HHS. In a press conference, it was mentioned that the NPRM for “meaningful use” will be released soon. Also, the field should anticipate an NPRM on accounting for disclosures.
